Terms of Service

These Terms of Service ("Terms") govern access to and use of the Gilgul Corporation website and related services, including donation processing, the online bookshop, open-access publications, and workshop registration (collectively, the "Service"). The Service is operated by Gilgul Corporation ("Gilgul," "we," "us," or "our"), an IRS-approved 501(c)(3) public charity (EIN 39-2673169) located at 400 North Wood Ave, 2nd Floor, Linden, NJ 07036. By using the Service you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

1. Eligibility

You represent and warrant that you are at least 18 years of age (or have the consent of a parent or guardian) and legally authorized to enter into binding agreements.

2. Use of the Service

2.1 Permitted Use. The Service may be used to learn about Gilgul's work, donate, purchase books, download open-access publications, and register for workshops for personal, educational, or non-commercial scholarly purposes.

2.2 Prohibited Conduct. You agree not to:

• Violate any applicable law or regulation.
• Misrepresent your identity or affiliations.
• Interfere with or disrupt the operation or security of the Service.
• Attempt to gain unauthorized access to any systems, data, or accounts.
• Scrape, reverse engineer, or harvest data from the Service.
• Submit fraudulent donations or payment information.

3. Donations

3.1 Charitable Contributions. Gilgul is a 501(c)(3) public charity. Donations made through the Service are tax-deductible to the fullest extent allowed by U.S. law. Gilgul does not provide goods or services in exchange for donations unless explicitly stated.

3.2 Receipts. A donation acknowledgement and tax receipt will be emailed to you automatically following a successful donation. Please retain this receipt for your records.

3.3 Refunds of Donations. Donations are generally non-refundable. If you believe a donation was made in error, send us a message within 30 days.

3.4 Payment Processing. Payments are processed by Stripe, a PCI DSS Level 1 service provider. You represent that you are authorized to use the payment method you provide.

4. Book Purchases

4.1 Fundraising Sales. Proceeds from book sales support Gilgul's charitable mission. Book sales are not donations and are not tax-deductible.

4.2 Shipping and Delivery. Estimated shipping times are provided at checkout. Title and risk of loss pass to you upon delivery to the carrier.

4.3 Returns. Damaged or defective books may be returned within 30 days of delivery for replacement or refund. Send us a message to initiate a return.

5. Open-Access Publications

Reports, translations, and commentaries marked as "open-access" are made freely available under a Creative Commons Attribution-NonCommercial 4.0 (CC BY-NC 4.0) license unless otherwise noted. You may share and adapt these works for non-commercial purposes with proper attribution to Gilgul Corporation and the named authors.

6. Workshops and Events

Free workshops are offered as part of Gilgul's educational mission. Registration may be required and seats may be limited. We reserve the right to reschedule or cancel any workshop.

7. Intellectual Property

7.1 Gilgul IP. The Service, including all software, designs, photographs, video, scholarly content, the "Gilgul" name, and our logos, is owned by Gilgul Corporation or its licensors and is protected by intellectual property laws.

7.2 Restrictions. Except for open-access publications licensed under Section 5, you may not copy, modify, distribute, or create derivative works from the Service without prior written permission.

8. Scholarly Content Disclaimer

Research, translations, and commentaries published by Gilgul represent the scholarly views of their authors and are offered for educational purposes. They do not constitute religious doctrine, legal, historical, or professional advice.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GILGUL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GILGUL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. IN NO EVENT SHALL GILGUL'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO GILGUL IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US$100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Gilgul Corporation and its officers, directors, trustees, volunteers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to your use of the Service or your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access to the Service for violation of these Terms, misuse of the Service, or to comply with legal requirements.

13. Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-laws principles. Venue for any dispute shall lie in a court of competent jurisdiction located in Union County, New Jersey.

14. Changes to These Terms

Gilgul may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. Changes will be posted here with a revised "Last Updated" date.
